[damoberg] If you have a progressively enhanced web page, where you have a version for no javascript which is enhanced in some steps. To support WCAG 2 AA, do you have to fulfill that in each enhanced step?

    [garcialo] @damoberg Yes.

[deconspray] Anyone know if and when an updated Screen Reader Survey will be released by WebAIM?
  6. [tink] Haven't heard any word of a new survey.

[joefraley] i'm confused by the legal status of fully private websites (those accessible only by paid membership) in the US
  8. [joefraley] for example, this hearing: http://commdocs.house.gov/committees/judiciary/hju65010.000/hju65010_0f.htm opens...

At issue in particular is title III of the ADA which requires a subset of private employers, including most businesses to which the public has access, to ensure that individuals with disabilities have full and equal enjoyment of the facilities they provide when the provision of such access is reasonable.

  9. [joefraley] are there any existing regulations that apply to paywalled, non-publicly accessible websites?

[car] @joefraley Who are the paid members? What if some of them find the website difficult to use? Wouldn't they be extra grumpy about that, given that they paid to be in the club? :) (Sorry, I know that doesn't answer your exact question. Maybe @karlgroves knows more about the legal side).
  11. [joefraley] @car absolutely. in my case i work on a team that's pushing back on the value of accessibility, and it would be nice to point at an unequivocal legal obligation and sidestep the whole question
  12. [joefraley] but my current understanding is that there are no such unequivocal legal obligations for private websites

[caesar] @deconspray no idea about WebAIM, but if you're looking for something more recent maybe you can use the UK.gov survey? https://accessibility.blog.gov.uk/2016/11/01/results-of-the-2016-gov-uk-assistive-technology-survey/
  14. [car] @joefraley Is anything in law unequivocal? <grin>
Anyhow, believe it or not, there may be more answers tomorrow:

"The Section 508 refresh is expected to be published in the Federal Register on January 18, 2017".

[karlgroves] @joefraley I am not a lawyer, but I’ve been around a while. The only way to get around ADA would be if your website was for an organization that is wholly exempted from Title II. In other words, a country club or a place that is 100% members-only.

[joefraley] would you call Netflix 100% members only? i think you can only use it if you have a free trial or pay for membership
  17. [karlgroves] No. The product is offered to the general public. The membership, in that case, is more like a subscription to services.
  18. [karlgroves] A country club, on the other hand, has other conditions for membership that go beyond the need to afford the amount of money for dues.
  19. [joefraley] hmmm, that makes sense. thanks!

  21. [karlgroves] We haven’t talked for a while. Are you going to CSUN?
  22. [cordelia] i’m not sure yet

[caesar] Question about compatibility testing - how many of you would perform a distinct test between different Windows versions (all else - i.e. browser and AT - remaining the same)
