Abstract

This extension provides concepts to support implementations of the EU Health Data Space ([EHDS]) regulation by providing concepts and methods for implementing the regulation, as well as to support its alignment with other regulations such as GDPR, DGA, and AI Act.

NOTE: This is a draft vocabulary, which is being updated as the EHDS text is published and formally recognised as a regulation. Currently, for the next release we are working on concepts related to entities, e.g., manufacturers of EHR systems and digital health authorities, data categories, e.g., electronic health data, purposes, e.g., healthcare service provision, technologies, e.g., EHR systems or wellness applications, rights, e.g., of natural persons, and organisational measures, e.g., data requests and activity reports. The DPVCG welcomes participation and contributions for this work.

DPV Specifications: The [DPV] is the core specification that is extended by specific extensions. A [PRIMER] introduces the concepts and modelling of DPV specifications, and [GUIDES] describe application of DPV for specific applications and use-cases. The Search Index page provides a searchable hierarchy of all concepts. The Data Privacy Vocabularies and Controls Community Group (DPVCG) develops and manages these specifications through GitHub. The peer-reviewed article "Data Privacy Vocabulary (DPV) - Version 2.0" (2024) describes the current state of DPV and extensions from version 2.0 onwards, with an earlier article (2019) covering how the DPV was developed (open access versions here, here, and here).

The [EHDS] is an upcoming regulation that establishes a data space for the sharing and reuse of 'health data'. The regulation is expected to be published in 2025, and will outline the specific framework and obligations for implementing the health data space(s). The document establishing an agreed text between the EU's law-making bodies can be found in the associated press release (direct link to PDF). While the final text will contain revisions, the intent and implementing aspects of the regulation can be expected to be the same.

The implementation of the [EHDS] is of great interest due to its potential for unlocking and expanding the use of data currently stored in various health institutions, and to use this for progressive scientific research that will enhance healthcare and benefit society. For this, the HealthData@EU Pilot is a pilot project that is building the infrastructure for implementing the [EHDS]. It is creating the HealthDCAT-AP specification, which expands the well-adopted DCAT-AP specification for specifying metadata and catalogues of health datasets, which can then be accessed and reused via a common portal.

The [HealthDCAT-AP]'s specification reuses [DPV] concepts and properties to represent information about personal data, legal bases, purpose, and jurisdiction. See the note on DPVCG mailing list for more details. The aim of this extension is thus to support implementations like [HealthDCAT-AP] by providing a specific vocabulary that extends [DPV] concepts to represent the categories of personal data, legal bases, purposes, technical and organisational measures, and other processes and artefacts that are necessary to implement and support the [EHDS]. In this, we seek to work closely with efforts such as the HealthData@EU to avoid duplication of efforts and to develop a consistent and useful solution for stakeholders.

The rest of the document describes a draft vocabulary that was developed based on the initial documents of the [EHDS], and which shows how the concepts from the regulation can be modelled within the framework of [DPV] specifications to enable implementing the requirements of the [EHDS]. As the state of the [EHDS] regulation progresses towards a formal publication and then real-world implementation, the DPVCG will be updating this vocabulary with more concepts and guidance to support use-cases.

Issue 201: Support HealthDCAT-AP for EHDS WIP help-wanted eu-ehds

tldr; the draft HealthDCAT-AP, an extension of DCAT-AP used in EU open data portals, has recommended use of DPV for modelling legal basis, purposes, and personal data categories. I propose we support this by providing an EHDS extension and work alongside the group to further support use of DPV.

The HealthData@EU project is a pilot version for implementing the European Health Data Space (EHDS) regulation which will enable secondary use of health data from EU organisations. The project is developing a specification called HealthDCAT-AP which extends the DCAT-AP specification currently used to register and manage datasets in the EU (and other national) open data portal. This means all health datasets being shared as part of the EHDS implementation will be required to utilise this specification in order to be accepted and reused through the health data portals.

The draft HealthDCAT-AP specification https://healthdcat-ap.github.io/ shows the current progress regarding these activity, and references DPV explicitly as part of its best practice recommendation.

Section 1.3 on use of DCAT-AP for secondary health data management states: "To effectively extend DCAT-AP, several best practices are recommended: ... Prioritizing vocabularies used in DCAT-AP for metadata property selection, ... as well as considering Data Privacy Vocabulary (DPV)"

Section 7.6 on the metadata properties for Datasets describes the use of dpv:hasLegalBasis, dpv:hasPersonalData, and dpv:hasPurpose.

Section 8.13 Legal Basis further states the use of dpv:hasJurisdiction and dpv:hasLaw.

Section 11.4.2 Personal Electronic Health Data states " Data holders are also further encouraged to detail the sensitive nature of the dataset: This is achieved by utilising the personal data property and providing the list of key elements that represent an individual in the dataset. It is required to adopt the predefined classes listed in the extension of the Data Privacy Vocabulary (DPV) Specification "Extended Personal Data categories for DPV" (DPV-PD). The DPV-PD provides additional concepts regarding Personal Data categories. "

Section 12 contains RDF examples showing the use of DPV, though these only use DPV's properties and do not use DPV's taxonomy e.g. purpose is a string/text description and doesn't include DPV's purpose concepts.

Based on the above, it is clear that the DPV is desired and appreciated in the creation of specifications which must incorporate legally relevant metadata. Achieving this would be a fantastic impact given the scope and scale of the EHDS, and would also be instrumental in paving the way for similar reuses of DPV in other data exchange portals and specifications - especially those within the EU Data Spaces regime which will also be likely to use and extend the DCAT-AP.

To support this, I propose we explicitly support the EHDS implementation, in particular the HealthDCAT-AP, by creating an EU-EHDS extension that provides relevant concepts for legal basis, personal data categories, and purposes as defined in the regulation. Doing this would further justify the role and usefulness of DPV within the HealthDCAT-aP specification, and would show how powerful (and simple to implement) the DPV's modularity and extensibility are in practice.

I also propose working closely with the project to provide best practices and suggestions regarding the use of DPV's taxonomies within the HealthDCAT-AP as a suggestion so as to provide richer metadata and support data governance and regulatory compliance practices. For example, by tagging whether a purpose is specific diagnostic research or population health research, the appropriate approval mechanisms and compliance requirements can be derived and assessed based on the available metadata, as well as used in risk and impact assessments..

This section contains concepts representing the categories of data described in the EHDS. The EHDS defines 'electronic health data', which encompasses both personal and non-personal electronic health data. Furthermore, Article 14 defines priority categories of personal electronic health data for primary use, and Article 51 establishes the minimum categories of electronic health data for secondary use. In the next iteration of this extension, the categories of Article 14 and 51 will be aligned with the [EHDS] concepts of personal and non-personal electronic health data.

In future iterations, the DPVCG is interested in further refining this vocabulary by aligning the concepts with those from [DPV] - in particular to establish personal data that are sensitive, and personal data that are classified as special category for use with the [EU-GDPR] extension. The DPVCG is also interested to align and enhance the categories of personal data with the [PD] extension, and the [SECTOR-HEALTH] sectorial extension which models generic healthcare concepts.

The DPVCG is interested in providing guidance on how to use these concepts to express primary and secondary use scenarios.

In future iterations, the DPVCG is interested in further refining this vocabulary by aligning the concepts with those from [DPV] - in particular to establish purposes that can be considered as relevant to the provision of healthcare, or for public benefit, or are necessary for medical research. This section contains miscellaneous concepts that can be considered as processes under the EHDS. These will be changed in future versions of the extension. The current concepts of 'health data request' and 'data permit' represent the mechanisms through which data is to be requested and through which it will be permitted to be used. The DPVCG is interested in modelling these in terms of specific activities - including how to request, how to express information in a request, lifecycle of a request (e.g., request made, being considered, accepted, or refused), and the accompanying assessments (request validity, risk/impact assessment), and documentation (request log, request report). Likewise, the use of data will also require specific concepts that model such specific processes and artefacts. Further, the DPVCG is interested in establishing specific legal bases and mechanisms that are crucial for the implementation of the EHDS, including its alignment with other extensions implementing regulations such as [EU-GDPR] and [EU-DGA].

Issue 201: Support HealthDCAT-AP for EHDS WIP help-wanted eu-ehds

tldr; the draft HealthDCAT-AP, an extension of DCAT-AP used in EU open data portals, has recommended use of DPV for modelling legal basis, purposes, and personal data categories. I propose we support this by providing an EHDS extension and work alongside the group to further support use of DPV.

The HealthData@EU project is a pilot version for implementing the European Health Data Space (EHDS) regulation which will enable secondary use of health data from EU organisations. The project is developing a specification called HealthDCAT-AP which extends the DCAT-AP specification currently used to register and manage datasets in the EU (and other national) open data portal. This means all health datasets being shared as part of the EHDS implementation will be required to utilise this specification in order to be accepted and reused through the health data portals.

The draft HealthDCAT-AP specification https://healthdcat-ap.github.io/ shows the current progress regarding these activity, and references DPV explicitly as part of its best practice recommendation.

Section 1.3 on use of DCAT-AP for secondary health data management states: "To effectively extend DCAT-AP, several best practices are recommended: ... Prioritizing vocabularies used in DCAT-AP for metadata property selection, ... as well as considering Data Privacy Vocabulary (DPV)"

Section 7.6 on the metadata properties for Datasets describes the use of dpv:hasLegalBasis, dpv:hasPersonalData, and dpv:hasPurpose.

Section 8.13 Legal Basis further states the use of dpv:hasJurisdiction and dpv:hasLaw.

Section 11.4.2 Personal Electronic Health Data states " Data holders are also further encouraged to detail the sensitive nature of the dataset: This is achieved by utilising the personal data property and providing the list of key elements that represent an individual in the dataset. It is required to adopt the predefined classes listed in the extension of the Data Privacy Vocabulary (DPV) Specification "Extended Personal Data categories for DPV" (DPV-PD). The DPV-PD provides additional concepts regarding Personal Data categories. "

Section 12 contains RDF examples showing the use of DPV, though these only use DPV's properties and do not use DPV's taxonomy e.g. purpose is a string/text description and doesn't include DPV's purpose concepts.

Based on the above, it is clear that the DPV is desired and appreciated in the creation of specifications which must incorporate legally relevant metadata. Achieving this would be a fantastic impact given the scope and scale of the EHDS, and would also be instrumental in paving the way for similar reuses of DPV in other data exchange portals and specifications - especially those within the EU Data Spaces regime which will also be likely to use and extend the DCAT-AP.

To support this, I propose we explicitly support the EHDS implementation, in particular the HealthDCAT-AP, by creating an EU-EHDS extension that provides relevant concepts for legal basis, personal data categories, and purposes as defined in the regulation. Doing this would further justify the role and usefulness of DPV within the HealthDCAT-aP specification, and would show how powerful (and simple to implement) the DPV's modularity and extensibility are in practice.

I also propose working closely with the project to provide best practices and suggestions regarding the use of DPV's taxonomies within the HealthDCAT-AP as a suggestion so as to provide richer metadata and support data governance and regulatory compliance practices. For example, by tagging whether a purpose is specific diagnostic research or population health research, the appropriate approval mechanisms and compliance requirements can be derived and assessed based on the available metadata, as well as used in risk and impact assessments..

Issue 238: Update EHDS extension with practical concepts WIP help-wanted eu-ehds

Update the EHDS extension with concepts from the regulation (trilogue approved draft) and practical concepts derived from it.

Issue 299: Model Purpose Compatibility statuses for EHDS todo help-wanted eu-ehds

Based on discussions in #283 the dpv:ReuseCompatibility concept should be extended as eu-ehds:PurposeCompatibility to represent the compatibility of purposes as defined and interpreted within the EU EHDS - in particular from definitions in Article 2 and the obligations under Chapter IV. The specific concepts modelling these are:

PrimaryUse: (EHDS Art.2-2d) means the processing of electronic health data for the provision of healthcare, in order to assess, maintain or restore the state of health of the natural person to whom those data relate, including the prescription, dispensation and provision of medicinal products and medical devices, as well as for relevant social, administrative or reimbursement services;
SecondaryUse: (EHDS Art.2-2e) means the processing of electronic health data for the purposes set out in Chapter IV of this Regulation, other than the initial purposes for which they were collected or produced;

These concepts should be accompanied with guidelines on how the interpretation of compatibility works by using DPV concepts, e.g. to test for compatibility, which DPV concepts should be compared.
